I guess you are saying that your current FLR is under work permit or HSMP. If that is the case, Yes, you can apply for Tier-1 months before your current FLR expires. The Home Office calls it Switching :)

I'm on hsmp and my visa expires Aug 09
I want to extent (switch) to tier 1 now for two reason:

1-I will renew my passport soon and I prefer the stamp to be on the
new one.
2-I would like to renew my visa while I can qualify as you never know
what is the home office upto every day...the rate of changing is so
rapid and no one can expect what will happened next year !!! it
seems to me that they wake up every morning thinking (how can we
S C R E W the migrant workers today !!!?)

So my question is HAS any body applied in the new system under these circumstances and got accepted ?....

Many Thanks

I think, the system has just come into action and the minimum time line is anything between 4-6 weeks,so anyone who has applied is yet to get the stamp :?
