URGENT - Doubt on UK Experience points

Hi,

I am applying for Tier 1 (General) visa in few days.

I have my previous earnings both from UK and India for the period 01st Dec 2009 to 30th Nov 2010. Out of this, more than 25,000 GBP were earned in UK. I am claiming 5 points for UK Experience.

I have been told that one needs to be in UK for more than 12 months to claim 5 points for UK Experience. I was in UK from 31st May 2009 to 27th Oct 2010 (which is around 16 months) but I am showing UK salary slips for 12 Months (i.e. Dec 2009 to Nov 2010) inspite of the fact that I was in India in the month Nov 2010.

I request you to look at my case and provide your experienced opinion if I am rightly eligible to claim 5 points for UK Experience.

Please let me know if you need more clarification on this. I would appreciate urgent support from the forum.

if you have payslips showing you earning 25K in the UK over lets say 12 months or so then that should be enough to claim points for experience I believe.

if your earnings in UK if from 12month then YES u can use UK experience but when u use UK experience u can not use conversion rate for indian salary if u r claiming

I have not found anywhere in the Guidance / Immigration Rules stating the requirement to be in UK for any certain period (let alone 12 months) in order to qualify; or have I completely missed something here?

I got Tier 1 (General) last month, claiming UK experience. Just to give you a picture, the first half of income was from UK, the rest from overseas (so as my work location).

So, to answer your question, you should be able to claim points for UK Experience.

@innocentdevil: I have payslips UK for 12 months but I was back in India in my 12th month and this is my area of worry.

@tvn_ramesh: Same answer to your reply. Yeah I am aware that I cannot uplift my Indian salary when I was in UK. I can only uplift my 12th month salary since I was working in India during that time. I hope you mean that I cannot uplift my salary rather than converting into pounds sterling (which I will have to do in any case).

@ Natita: I totally agree with you, even I couldnt find it anywhere mentioned in guidance policy. Looking at your case, I am hopeful to claim 5 points for UK experience now. Thanks a lot. BTW I have T1 General Guidance document. Is there any other Immigration Rules I can refer to for more clarity?

The Guidance refers to Appendix A, table 3 and paragraphs 24-30 of the Immigration Rules. Here is the link.

I earned my UK salary on Work Permit Visa and not Tier 1 visa. Am I eligible to claim UK Ekperience points based on Work Permit Visa?
