I am currently applying for and EB1 visa with my wife and child as dependents.

My son (age 14) is my wifes from a previous relationship, but I have brought him up as my own from a baby and am his dad.

I was reading the criteria for submitting the I-485 applications for dependents and am worried that I will not be able to submit this for him as my name is not on his birth certificate. I have also never legally adopted him.

Can someone please give me some advice on this.
