difficult situation- Plz help

Post by deep_jagdeep » Tue Jun 12, 2007 11:20 am

my uncle applied a immigration case in 1996 from california
after a long wait now we get a interview letter
uncle applied my case under f4 categ.
he filled case for my dad
now in interview letter
my name is not present there
may be because i am over age i.e. now i am 21 years and 10 months old
but many people told me to attend interview, they said consular may give me a visa with my family
i also think so because uncle pay my visa fees and fill every form
only this last letter comes to us after completion of 21 years of age
before that they consider me with my family but now at end
they does not enter my name to letter
in embassy, receptionist said me to attend interview with my parents because
my name is there in computer but not in letter

i m India and my case is in new delhi embassy

plz help me out i m very worried about my future
plz tell me how much chances is there to get visa for usa with my parents

The problem is that you are not eligible for a visa under the fourth preference category (see here). This is for brothers and sisters of US citizens only, not for their nephews and nieces. Your best bet is probably for your father to emigrate to the US, become a US citizen, then petition for you (as long as you are not married). You may want to post in the following forum as well. Some users there have much deeper knowledge of US immigration law than I have, but I think they'll tell you the same thing.

but children can go to US with there parents under this categ. also.
because my younger brother is also going for interview
i m over 21 years thats why my name is not there in letter
in many cases consular gave visa to people over age limit
so i m confused
can i get visa or not?

As I mentioned earlier, in my opinion the answer is no. Sorry. If you would like a second opinion, feel free to post in the other forum. Good luck.
