H2B Visa

H2B Visa

Hello there,

I got a free evaluation with Work Permit.com and a US Immigration Attorney told me that I qualified for a H2B visa.
I am from France, 22 years old and got an employer here in the USA. I adked them to fill the petition form already.

I got my letter of employment and my question today is Do I need an attorney for a H2B visa ? Or should I wait for the petition form from my employer then to apply for the H2B visa ?

Pretty much everyone "qualifies" for it, it's a visa for unskilled laborers.

The employer needs to apply for the visa, not the worker. The employer needs to have Department of Labor Certification, and they need to show they were unable to recruit local workers. Does your employer have Labor Certification? Do they know how to apply for H2B visas? If so, let them take care of it. If not, you might as well look for another employer.

By the way, are you currently visiting on the Visa Waiver Program? If so, you will need to go back to France before re-entering on an H2B visa. With very few exceptions, you are not allowed to switch status under the VWP.

Yes I am a part of the VWP so I have to comeback in France to apply for it.
Does your employer have Labor Certification?
I do have absolutly no idea of this. I will ask for it on this coming Monday.
Any other suggestion ?

Is there a need for Hepa B profile or test for H2B visa?
