I entered the USA on a visa waiver last year - I'm a dual Aussie/Brit and engaged to an American (we applied for the US fiance visa but gave up on the excruiating wait times and have since then cancelled and applied for the Australian fiance visa and are marrying in Australia in Feb '07).
I plan on entering the USA for 33 days on 6th September - my fiance and I are going to the UK for a vacation (as I was born in Wales and immigrated to Australia) for 16 days on 8th October - when we return to the USA I am only staying until 4th December - I carefully worked out that 6th Sep - 4th Dec is under 90 days, even though I will not be in the country for the full 90 day period.
My question is: I plan on being very honest, as I always am, on entering and will tell them all of the above info (they questioned me a lot last time - sometimes they do, sometimes they just want your dates and that's it). So should I tell them I plan on leaving for 2 weeks and re-entering for another month only? I have all my marriage documents (letter from Justice of the Peace etc) and will be carrying them with me to show them proof I plan on returning to Australia. Or should I just tell immigration 32 days is how long I plan to stay (I'm entering at SFO) and when I re-enter (at Boston) with my fiance tell them I am staying 44 days on this visit - because I'm thinking they will stamp my passport on the way out and that first visit will be over and a new visit will begin when I enter again?
I know it is not advisable to use a different passport to come back in so although I have two passports - Australian and British - I will just use my Australian (unless I am advised otherwise). Any advice would be greatly appreciated!
Let me make sure I clarify - I am not asking staying for 90 days on my first entry, nor am I asking for 90 when I re-enter. I only need 33 days for my first visit in Sept-Oct and 42 days for my next visit Oct-Nov. I'm thinking maybe I'll be direct and tell the immigration officer this when I enter in a few days...
