Hi All,
I have couple of queries regarding OCI Card for my son who is a Minor, please go through them and clarify or share your experience if you have/had any similar situation.
I'm currently a British Citizen living in the UK, so I hold British Passport. I also hold Indian OCI card. My wife is Indian Citizen living with me in the UK and she holds family visa to live here in the UK with me. My son was born in India, when he was born I already had a British Passport. So he was eligible for British Citizenship by descent. Because he was born in India we didn't apply for his British Passport straight away instead we applied for his Indian Passport and UK Home Office granted him the "Certificate of Entitlement to Right of Abode" to travel to the UK. When our son came to UK we applied for his British Passport and we got one now. By then and even today UK Home Office clearly said/says we don't need any "Naturalization Certificate" nor "Certificate of Registration" for our son to get British Citizenship & Passport because he acquired British Citizenship by birth, reason being I was already a British Citizen when he was born, even though he was born in India, not UK. Refer to the URL below which clearly says this.
Now, we are planning to apply for our son's OCI Card. My query is - In the OCI application form in section "Part B (Other Details Of Applicant(s)[Applicable to all categories]) - point #6", there is "Date and method of acquisition of present nationality (By Birth/ Descent/ Registration/ Naturalisation)", refer to the screenshot below. I'm not sure if I have to choose it as "By BIRTH" or "Descent". Can you please clarify this?
