ILR after Marriage Visa for 2 Years

ILR after Marriage Visa for 2 Years

Hello,

I got Permanent residence in june 2004. I got married in 2004 november and my wife is staying with me for past 2 years in UK. She was given Marriage Visa for 2 years. This visa is getting expired in december 2006. I would like to know if my wife can apply for ILR.

If she can apply for ILR can you please let me know what are the documents we should provide while applying.

Oh dear, it seems like you have not already downloaded the form SET(M). In which case do that now.

I say "Oh dear" because, well let's just hope you have all the right sort of documents.

Recommendation ... anyone in the UK on a 2-year spouse visa, or 2-year Unmarried Partner's Visa, or 2-year Civil Partner's visa ..... if you have not already done so, download the SET(M) today ... even if the date for applying for ILR is months or over a year away ... then study the documentary requirements when the application is made.

In the application form, it is asking for over 2 years of documents which provides evidence of myself and my wife staying together.


I have the evidence of tenency aggrement, bank details, council tax. For other bills i had just my name.

She is currently working, hence she have her NI number, payslip etc.

Is this ok for applying.

As long as the documents are spread out in time over the two year period, yes, fine.

The application can be made no earlier than 28 days before the expiry of the current 2-year spouse visa, and no later of course than the actual expiry date.

I got Permanent residence in june 2004.
Since getting that have you gone on to get Naturalised as British? If yes, and your wife entered the UK on a fiancée visa prior to marriage in the UK, note that she can also apply for Naturalisation as British as soon as she has been in the UK for 3 years, and of course has her ILR.

Hi there,

My wife is due for her ILR using the set(m) form. We have our appointment soon. And am putting together the paperwork. However we moved house twice in the two years and as I moved out from a family home I didn't move all my addresses. So until 4-5 months ago some of my stuff was in one place and hers in another. Although now it is consolidated in one. So now the question is what all do I need to provide in terms of having limited docs from early on in the two years and then docs with diffrent address. Yes I have read the form but would like any further advise and also as we are going for an appointment. What can I expect at the home office?

Any help appreciated

The idea is to prove that the two of you were indeed living together at a particular address at a particular point in time.

Do look at the whole list of possibilities mentioned on the SET(M) form. Don't just consider the obvious things like bank statements or payslips.

Having done so, what gaps in time do you have?

thanks for your quick reply. having sorted thru some of the paperwork last night (yeah I know I have left it late (appointment on Friday) but had alot of other things going on). In terms of bank statements and wage slips there is not a problem of number. The problem is that when I was living at our family home I had no bills in my or her name (home office were aware that we were living at my mums and this was clearly stated tot hem in a letter from my mum when we got our fiancee visa from Wellington (NZ)).

So basically I have got wage slips and bank statements. And orange phone bills. She has got bank statements but her wage slips are addressed to her at work. I have almost nothing in her name at my mums address for the first few months after we were married as she was just getting settled intot he country and not doing anything.

Since we moved house to our own home in Jan/Feb. We have got joint and single named utility bills from then onwards. The house was bought on sole name to me on a mortgage.

With that sort of data would we be ok?

I thought best to go in person to clarify anything if need be.

What is the worst case scenario to expect?

Again any help appreciated.

If that is really all you have got then so be it, that is all you can take with you.

However I suspect .... and I admit, quite possibly wrongly .... that there are other types of evidence that you are not yet considering. NHS cards? Letters from any type of Government Department? AA/RAC/Green Flag membership cards? Car insurance? Any type of insurance at all? etc etc.

And when you say (with my emphasis) :-
I have almost nothing in her name at my mums address for the first few months
