Quick Help Needed for the Entry Clearance Form -

Hi,
I am just posting this on behalf of my friend who is applying for EC after HSMP approval.

She filed her first HSMP application as an in-country applicant. She sent her passport alongwith FLR application to HO on the basis of the HSMP application because she did't receive the decision before her current visa was due to expire. After her visa expired, she received HSMP decision and it was't successful so HO sent the passport back along with the standard letter to leave the country.

Then she left the UK and applied from her home country. Now her application has been accepted and she has to apply for EC. There are couple of question on the EC application form.

- Have you ever been refused a visa to the UK ? Y/N
- Have you ever been asked to leave the country ? Y/N

What should she answer for the above two question? Because she applied for the FLR on the basis of the HSMP. Is it treated as visa refusal ?

Hello,

HSMP is NOT an immigration decision udner IA 1971, so she was NOT refused a visa.

Now, unless she WAS removed from the UK or there was a letter directing her to LEAVE the UK as illeagl entrant/overstayer, she, again, must put NO in the answer box.
