Non EEA national spouse of EEA national applying for ILR

Hi can anyone help,i am a non eea spouse of an eea national and i have completed my five year period during which both me and my partner has been working so we have all documents intact ie p60,s payslips etc and my five year period finishes at the end of feb 07 so i am eligible to apply for ILR the only problem is i just found out that my partners passport has expired and she also recently lost her purse which contained her spanish id card and she is in the process of applying for a new id card via the spanish embassy and even though she is not applying for ILR i have to send her passport or id card with my application some people have advised that i can send her blue residence card which was issued to her five years ago when we first came to the U.K others says i can send the expired passport but i am all confused so can any one advise asap as i have only four days left before i submit my application cheers.

Once you have spent 5 years in the UK as the spouse/partner of an EU/EEA/Swiss national "exercising Treaty Rights" you automatically acquire permanent residence.

The EEA4 application is for evidence of this, not the status itself. So I would suspect you can use substitute evidence that shows your status, although don't be surprised if the Home Office want to see a valid passport/ID card for your wife.

Why does your Spanish partner not want to apply for Permanent Residence as well? Do either of you want to become British citizens in due course? Also, have you got UK born children?

Thank for your reply,no we havent got a child so you reckon if i send the expired passport and the residence permit card they might request for her valid passport,
