Dependant Spouse drama

Hi all

I am currently on a WP and have recently been approved for HSMP.

I have not filed the FLR form yet as I want to include by partner as dependant spouse but my agent seems to keep forgetting this major information which I have told them from the start.

Anyway my partner is currently in the UK on a working holiday visa.

My question is can I just include him on the FLR as dependant spouse without him leaving the UK or would he have to go back home to apply?

Originally the migration agent said I could do this but now they are suggesting otherwise. Please help.
