Naturalisation

Hi,

I am married to BC and have been living in the UK for the last 3 years. I have 4 children aged 12,14,16,19 whom are also resident here for the last 3 years.

I am confused whether to include my eldest child on my application or not? could you please clerify

All four children clearly came to the UK on a settlement visa as minors, so yes I would think you can include them all.

Hi,

Initially All of us had 2 years limited leave to remain but were given ILR after this time.

I am sorry, but I donot think that it may be entirely correct. There is good chance that the waiting time would be closer to 5 years than 3 years for the naturalisation as the 3 years exception are only for persons married to BCs.

I will let someone with better knowledge to come along and verify.

Jabi, that is correct, except "closer to 5 years" should be 5 years! The 19 year old is now an adult and in the absence of marriage to (or Civil Partnership with) a British Citizen it is not possible for that ex-child to apply for Naturalisation, until they have been in the UK for 5 years. Not only that, he/she will need to pass the Citizenship Test before applying for that Naturalisation.

The minor children, now aged 12, 14 and 16, an application for Naturalisation as British is not going to be made in respect of them. Instead applications will be made to Register them as British, at the same time as you apply for your Naturalisation. The difference between Naturalisation and Registration? Once granted, effectively no difference. However during the application process there are differences. For example, an applicant for Registration does not need to pass the Citizenship Test, something that will no doubt please the 3 children!

I hope you are using the latest forms. I say that because it is now the case that a separate form MN1 needs to be completed for each minor child. But certainly ensure that all the forms, yours and theirs, get submitted together.

Presumably sajidmahmood you have already passed the Citizenship Test?
