Any solicitor here? Answer needed urgently, Please help!

Hi,

I know it's a bit long story but here is the case:Two oversea student couple got married at 15 yeas ago, they both had the student visa until the husband switched to dependent visa in the 2nd year of the marriage. then the husband got the ILR based on 10years rule and became a British citizen the year after.

Then the wife switched to spouse visa and then got ILR and citizenship after 2 years. But they actually broke up by the time when the husband got the ILR and they were no longer live together , They pretend still in marriage to help the wife to get the citizenship.

Now the question is what result will they get if HO finds out? And how to report this case?

Sham reporter what the couple have done is wrong.UKBA will not let you know what action they are taking.If you want to report them use Google i think it will be the first page.

broke up you mean divorced or just living separately? If divorced then the case is different

if not then It just doesnt matter. As long as the applicant is married to a British citizen. There is no such requirement of living together. Even if they are separated and live in different city. Its not mentioned anywhere in BNA 1981 and not in any of the UKBA guideline

For spouse naturalisation, the British Nationality Act only requires that the applicant be married to a British citizen on the date of application

For BC spouse route one of the main thing from my understanding is proving your married to a british citizen . seperated or not providing you satisfy the residential requirements and other factors.

you think it's so easy to remove British citizenship?

until now 21 people lost their citizenship ; Almost all of those affected lost their citizenship on national security grounds

askmeplz82 if the relationship was not subsisting at the time of SET(M) ILR then the application would have been refused. However, I think the OP should have better things to do than to try and pursue such frivolous actions.
