Do I qualify to apply PR for spouse who is Non-EEA national?

Post by rizla » Sun Apr 29, 2007 1:37 pm

I moved from sweden to Germany then I applied for my wife to come and join me from Ghana to Germany. I later decided to come to Uk to study in september 2000 but upon arrival I did not register with HO for resident permit. In october 2002 I applied for my wife to come and join me in UK from Germany and was issued with 1year visa. she arrived from Germany march 2003 on 1yr visa for family member of EEA citizen. in october 2003 the 1yr expired and we both applied for resident permit and was issued with 5yrs resident permit and this expires in december 2008. Both of us has been working and schooling since arrival in this country. I have been talking to loads of Banks and because my wife has not got PR they cannot offer us with a mortage this driving me mad so I want to know if there is any chance for me to apply for PR anytime from now.
thanks in advance

I think the answers you got previously were clear. What is it you do not understand?

When you have had PR for at least one year. In other words, from 30.04.07 .... tomorrow!

Your wife can apply for her PR only after being in the UK for at least 5 years. So as "she arrived from Germany march 2003", it sounds like she can apply for her PR some time in March 2008.

So the scenario could be :-
  1. Assuming of course you have passed have passed the UK's Citizenship Test, you can apply for Naturalisation as British. If you apply soon there is a very good chance you will be British before the end of 2007.
  2. In March 2008 your wife applies for her PR.
  3. Once she has her PR, given that by then she could be married to a British Citizen ... you! .... she can immediately apply for her own Naturalisation as British.
If neither you nor your wife have studied for and passed the Citizenship Test, why not study together? The pass certificate does not expire, and can be used whenever it is needed.
