ILR Advice on Timing of Application forTotal Absences Abroad

Post by SidB » Fri Jul 27, 2007 11:39 pm

Hi,

I got my work permit stamped in country in June 2003 but I started working in August 2003. Since I had a gap of a one and a half months between my graduation and job start date, I took a holiday and went travelling.

I know I can eligible to apply anytime from May 2003. However, if I apply in May, my total absences over the 5 year period will be around 260 days. However, if I apply a month before my start date, the absences are around 210 days incl. work travel.

Can anyone advise if 260 days is going to be an issue? Should I apply in May or July to ensure I'm reporting less number of days outside of the country? I want to avoid a situation where the application is refused over the counter because of absences, although I haven't heard of any such cases reported in this forum.

Please advise.

Many thanks.

hi sid
iam in the same situation as urs and my absenses are much more than urs. iam 404 days out of country and on one occation i was out for more than 90 days. but my absenses are for professional reasons. well when i had taken advice from solicitors many said the case is diffucult but when i have seen the consultants (not solicitors) they said its not a problem when u have a reason. well if u want we can share our expreiences by sharing our email ids, well mine is cheekywas@yahoo.co.uk

My personnal experience suggests that absences are not a problem as long as they are justified. For example due to professional / business related reasons. My absences were considerably more than 404 but got ILR ok. Make sure you justify your absences by a strong worded company letter. As far as the OP is concerned, I don't think he has to worry about anything.
