Hi Friends,

I was on Work Permit 24 months from June 2002 to June 2004

I went back to my country and after a month I came again here
on another new Work Permit.

It starts from Aug 2004 and ends on Aug 2007.

Can I apply ILR by now?

Unfortunately your ILR clock has been reset from Aug 2004, but others can comment on this

I was told by my friend that I could go for ILR straight away
instead of FLR.

I think, from your answer there is no point in going for
ILR now

It depends on other things, such as exactly how long you were out of the UK and what ties you had in the UK during the month away. Also, was the work permit application submitted before the old permit expired.

Doesn't the ILR clock reset if the EC was done outside the country and there was a gap between the 2 WP's?

If the second work permit was applied for before the first one expired then there is an argument that there was no gap.

So, to clarify, your first visa ran out in June 2004, and you left (what exact date?) and applied in your home country for a second WP, which you received and re-entered the UK in August 2004 (what exact date?)? For how long were you outside the UK?

First WP & stamping 07th June 2002 to 07th June 2004

I went back to my country and after a month I came again here
on another new Work Permit.
Second out country application on July 26th 2004

It starts from 31st Aug 2004 and ends on 31st Aug 2007.

Just apply with exceptional circumstances, it doesn't hurt except in the pocket

I would suggest to make a postal application and let home office figure out if they consider your stay continous or not. I wouldn't use exceptional circumstances, would just make a normal postal application. At worse you are going to loose application fee.

Two things, apply for ILR through a postal application as opposed to using the premier service.

Do disclose your absence(s) but in my opinion no need to cite any special circumstances.

Thanks everyone for taking time to answer my issue...

Is that by rule ...am I not eligible to apply?

I dont mind going for a trial..
but just wondering to know the fact...

Coz both my visas are Out Country...so they know
I clearly left the country and entered again.

By law if they reject me ...then they wont allow
me to appeal.

If I'm by law then atleast I get a chance to appeal...I guess...
Am I right?
