Naturalisation via Marriage

Post by Chess » Tue Sep 14, 2004 8:47 am

Does one have to be on ILR for 12months before applying for naturalisation via marriage?

Forexample.... if a student has been in UK for three years, marries and gets the probationary two years. After completeing the 2 years s/he obtains ILR based on marriage.

Since the person has been in the country for over 5 years - can they apply for naturalisation immedeately or must one be on ILR for 12 months prior to naturalisation?
Where there is a will there is a way.

An applicant for naturalisation who is married to a British Citizen only needs to hold ILR on the date of making the application - there is no requirement to have held ILR for 12 months. He/she must still meet all the other requirements e.g. 3 yr residence, full capacity, language ability etc.
