EEA1 and no passport

My baby, born in the UK has no passport yet as waiting times for an appointment in our consulate are very long. Can I, while applying for EEA1, attach his birth certificate and photos? I would also attach a letter explaining why his has no passport yet - he is already over a year but our passport (mine and my husband's ) have been for over 7 months by the Home Office due to his application for FRMS. Can HO refuse application because it's filled in with a blue ink(at least in part)? I don't want to bother my employer again..

No, the HO cannot refuse the application for the EEA1 even if the wrong from was used, let alone the wrong colour of ink. I do not know for sure abou the adding the child by using only the birth certificate explaining the whole thing. What do you have to lose? The application is free and at worst they will ask you to add him later after the passport has been issued.

There is no problem with applying without a passport. theyw ill just issue the visa on a seperate sheet of paper (I did this a few months ago).

They should normally issue a separate immigration document (A4 size folded paper).

How long have you been living in the UK and what EEA state are you from?

Also, what is the nationality of the child's other parent?

I'm since october 2005 in the uk and I'm from a new member state. my husband is from non-eu state. my child has both nationalities. does it have any influence on the application?

We kind of figured that out from the FMRS application bit. JAJ might be looking for specific nationalities, but the reason eludes me.
