Between jobs on work permit!!

Post by a.tayal » Sun Sep 02, 2007 10:08 pm

Hi,

I had been working for an IT company on work permit. Now I got an offer from another company who are ready to sponsor my WP for me. I accepted that offer. My new company says that it has applied for a work permit in mid-august. Now I am between jobs as I have left my previous company and have not joined the new company as the WP approval has not come yet.

Does anyone have any idea about any 'grace period' till when I can be in UK. Also, is there any way I can get the confirmation from Home office(like an acknowledgement from home office etc) to make sure that when has my new employer's lawyers have actually applied for the work permit.

Thanks in advance for the help.

The 'grace period' between jobs is 28 days. Don't know about the HO letter though.

Thanks a million for the reply Docterror.

Well I may be wrong but I have read that 28 days grace period is for the employers as if they apply for the WP within 28 days of the employee leaving the previous job, then they do not have to advertise in the newspapers. But, does it also apply to the employee staying at UK?

If possible, then can you give a link or something where I can see the grace period rule.

Thanks a lot for the help.

If the permit has been applied for I don't think you have anything to worry about. There is no strict rule, there is an unwitten guideline (or, if there is a rule, no one outside the Home Office knows it for sure).

I agree with Victoria, however ideally you should apply for new WP, get approval and then resign from your current job because it can be tricky sometimes.

All the best
