challengin FTT and UTT decision in JR(LR)

Hi guys !! I hope some one can help me
I am a dependant of my wife who is TIer 4 student. I came to the UK in July 2006 as a student and changed my status to dependant visa. I have stayed in the uk for 9 years already.
Our visa expired on JUNE 2014 and when applied for visa extension, it was rejected because the college withdrew the CAS.
WE appealed it on FTT(first tier tribunal) and UTT(upper tier tribunal) but the outcome was negative. Now we have lodged Judicial Review on JUne against the decision of FTT and UTT and our JR has been accepted . We are waiting for the hearing date,
Now my question is .
when we apply for JR after the decision of FTT and UTT will it be counted in the 10 years route lr or is it not ?
And how long does it take for the JR date to come?
Am i eligible to work or not? because when my employer did an employee check the home office sent a letter saying im not eligible to work.
I NEED SOME GENIUNE ANSWERS PLEASE AS I AM THINKING TO WITHDRAW MY CASE AND GO BACK HOME IF I AM NOT ALLOWED TO WORK AND IF THE TIME SPEND FOR THE APPEAL IS NOT COUNTED TO 10 YEARS ROUTE LR.I SEE NO POINT IN STAYING HERE.

ANy suggestions and informations will be much appreciated.

You became an overstayer the day after UTT refusal and continue to be so. Applying for JR doesn't change that one bit.
For the same reason, you have no right to work in the UK.

Whether your period of overstay can be overturned under some provision of the law (a big if) depends on the findings and outcome of JR.

I really do appreciate your help.
But when I called the homeoffice help desk for the informations about my working rights and explained my situation. He told me if i had my working rights before my visa had expired.. I would still be able to work legally..
I'm confused.
There isn't a clear information about the working rights when you go to the JR.
