Naturalisation & Arrest record

Post by MatsG » Thu Sep 27, 2007 8:09 pm

I have been arrested for domestic violence but had all charges against me dropped. Do I disclose this on the form under other reasons why we might suspect that you are not of good character? Guess I might do it since they will see it anway. This happened about 1.5 years ago but there is no rehab period specified for suspected criminal activities. The question is if it is just a waste of money trying to get citizenship?

No, I am not a wife beater and if I tried anything on then she would have kicked my arse anyway :). The whole thing was a misunderstanding but the police was 120% sure it was true even though my wife tried to tell them that it wasn't true (she even got arrested her self for assult against the police while trying to protest my innocence  ). They said she was to afraid to press charges and that they did it themself but dropped it. A big mess really... but at least my wife has a "clear" period to work against.

No, you need to disclose unspent criminal convictions, but based upon what you say you don't have any criminal convictions! So nothing to disclose.

No I don't have any conviction and have never had anything else to do with the police (never even got a parking ticket). What I thought was that maybe i should disclose it at point 3.11 in the AN form where it says:
"3.11 Have you engaged in any other activities which might be relevant to the question of whether you are a person of good character?"

given that in Annex D chapter 3.5.1 is says:
"3.5.1 Where serious allegations of criminal activity (including domestic
violence and child abuse) are made against the applicant
(whether anonymous or not), the police should normally be
asked to enquire and report. The police should be advised in
every case where the informant fears reprisals from the
applicant. Insufficient evidence to bring a case to court need
not preclude refusal."

Given that it is my only problem do you think it will be a major bump on the road to getting citizenship? Even if I don't add it to the application I'm sure they have it on file?

Have you engaged in any other activities ..............
But you haven't, have you! There was an allegation made, which you denied, and indeed your wife denied, so clearly you would answer that question .... no!

It is good to seek clarification, but based upon what you have posted, I think you are imagining a problem that does not actually exist.

Yeah, I think you are right… it’s just my imagination. Thank you for pointing it out to me.

If convicted in a court of Law. then say yes otherwise No.
you do not need to justify yourself. you are innocent until proven guilty. you are not guilty hence you are fine.
don't worry
