Appeal to the First-Tier Tribunal

Post by naeemsyed » Sun Dec 20, 2015 3:13 pm

Please bear with me and after reading patiently, I request and seek advice. Thank You.
=================================
My son (UK citizen) got married to a Pakistani girl in August 2015. They only had a week together after the wedding as he had to return back to work in the UK. She (his wife) submitted her visa application in Pakistan, but in her excitement, haste and being naive she handed her Pakistan Passport Pakistan (which could not be returned from the Visa Application Centre in Pakistan as it have been sent off) on the date she was given to attend. She did not realise that her Pakistan Passport would need to be shown to the IMO Health Professional for her health check to obtain the Tuberculosis Certificate.

So after 3 months in the NOTICE OF IMMIGRATION DECISION the only reason for REFUSAL OF ENTRY CLEARANCE was based on the missing Tuberculosis Certificate. The Passport was returned so now the Tuberculosis Certificate has been obtained.

Option to Appeal has been given so;

My questions are;
1. Am I am correct in making an appeal to the First-Tier Tribunal along with tribunal fee, but submitting only the photo-copy of the missing Tuberculosis certificate?

2. As there was no objection on any other part of her visa application or the supporting documents. I do not need to resubmit them?

3. Her Pakistan Passport has been returned to her. If the tribunal gives decision in her favour. Will she have to resubmit her Pakistan Passport to the Visa Centre in Pakistan?

4. Will the Visa Fee of £956 paid already at the time of the application stand or will she have to repay again?

5. Any idea how long this tribunal decision process will take, time?

6. If the decision is in her favour. Will her passport have to be resent to UK for visa? How much more time will be added?

Many Thanks
