Public Funds Rule and Tax Credit and a Giro

Hello - my husband recieves Working Tax Credit and my details are included within his claim. Our latest problem with Tax Credits is this...

I have just received a giro for almost 150 pounds. It is my name on the giro. There is no explanation as to why it has been sent let alone why it is addressed to me not Sean. I have no idea why it might be sent and no idea whether I am entitled to cash it in or not. As I am subject to immigration control I am not sure I can cash it in without breaching the public funds rule. Are you able to tell me my position on this?

You should probably find out the reason for the payment before cashing it.

i got our award notices today and it would appear they decided to pay child tax credit to me.

i spoke to the helpline and got them to change the payment arrangements so future payments get paid to my husband.

however, i still don't know whether i can cash in this giro without being in breach of the public funds rule.

yes, I think you can. But, if you want to play safe, send it back to them and ask them to reissue it in your husband's name.

Rowan, you have clarified benefits before, in this topic.

Given your family circumstances, and thus Tax Credits is not Public Funds for you, I do not think it matters whose name the giro is in. You are perfectly able to be a joint claimant for Tax Credits, given your spouse's UK immigration status.
