Need Help and Advice Please

Please advise. My Fiance currently lives in the USA and is a US Citizen, I am living in the UK and am a British Citizen.

It is planned that my fiance visit me in the UK at the end of Feb for 10 days, in a bid to be together, she then intends to return to the USA for a month, then return here to live with me. The intention was that within 6 months of her moving here we would go over to the USA and get married. We thought that we could then bring her back here to the UK again and request an extended stay up to 2 years?

I work for an international company and hope that within the 2 years my company would sponsor me to go workand live in the USA, I would then request a green card while there and remain in the USA with my to be wife.

I have done a lot of reading on the internet and have now got major concerns as to whether or not we are doing this the right way? We are desperate to be together and will get married in the UK or the US provided we can be together.

Please can you advise how we can best do this, I already have flight tickets paid for her visit in Feb and also her trip back in March. Would you advise her to travel on a Fiance visa in March and we get married while she is here then? Or travel on visa waver programme allowing her 6 months in UK ??? I am very worried so please help anyone

I am so in need of advise here urgently so anything you can give me would be appreciated.

Her coming to visit the UK for 10 days is no problem.

As far as after that, there are two options. #1 she could apply for a fiance visa. It is valid for six months and you must marry within that time. After the marriage, and before expiry of the visa, she should then apply for the 2 year spousal visa using form FLR(M). Or, you could travel back to the US with her and marry there, and apply for the spousal visa from the US consulate.

The problem with her entering as a visitor is that it is not intended for settlement and there is a no-switching rule. Even if she were to enter as a visitor and you were to marry in the UK, she would still have to return to the US to apply for entry clearance as a spouse.
