NO VISA & PASSPORT TILL NOW since 2004 to 2008

Hi i am from Mauritius, Actaully in LONDON now studying but since i sent my passport to home office in uk @ 2004 for a student visa i didn't receive till now 2008.
The problem is that i have been reufse twice, one time was in december 2003 when i came on the airport as a tourist , they interviewed mme on the airport and they didn;t allowed me entry as they let me out for one day only, then back to mauritius the next morning but didn't refuse they told me to apply for a entry clearance there in mauritius. so in march 2004 i went through embassy uk in mauritius , but i lied on my form that i never been remove. so they refuse visa.
in june 2004 i applied a new passport and went to study in IRELAND DUBLIN, got a visa of 1 month in dublin, Study was not at the level there ,so i travel to london during second week in dublin visa. Enter Uk london without immigration as i got a valid Ireland visa, join a college for nursing and send my passport for student VISA in july 2004 before my 1 month ireland visa expired .So till now april 2008 , i never see my passport again, once the reply me for report to the home office and gave me removal else will force deportation in croydon i went there submit all mmy paper college progress and attandence and my solicitor doing the appeal. but still nothing if they wanted to refuse y taking long y now after 3 years i already spend a fortune to study here which is still on.
SO i am still waiting even after all the letter my solicitor send them.
But now i got my finance which is an EU member , we being together since 3 years , we engage i already inform home office send photos a well , but now we want to get married , she already got her resisdential permit here. so any one can advice me what to do,
How to get my passport back , as i want to travel to mauritius to get married by next month in may 2008.
Will it a good idea to go back to mauritius to get married . because my solicitor requested home office to either give me time to finished my studies or to give me right to marride my partner.
Didi anyone got an idea , will it a good idea to go to home office to asked for my passport back and go to mauritius get maurried and then submit for clearance there itself.!!!!!!
