Can someone please advise me with being served wih a IS15IA

Post by makanp » Fri May 09, 2008 12:47 pm

Hi, I have an issue with my passport as well as a chance of not entering the U.K.
I went to the U.K on a 2 year working holiday visa.
Just before it came to an end, I submiited an unmarried visa application.
The British home office had my passport for 2 years to make a decision on this. During the 2 years I made numerous calls to ask what the progress was and was told it was "under consideration" until I eventually got tired of them taking so long that when I asked to withdraw it, they gave it back to me and wrote "served with IS15IA" with a black pen on my passport and my previous working holiday visa was expired by the time they returned it. So i had to leave the country.

They classed me as an overstayer when they were at fault for taking so long with it. I have a girlfriend in London and we have plans to marry next year, what can I do to get back to the U.K.
And if i choose to apply for a fiance visa, will they allow me to enter the U.K.?

I think this is very unfair as it was their fault for taking so long.
Im currently in South Africa, and my girlfriend lives in London. I would eventually like to marry her but will this prevent me from going back up to the U.K.?

Thanks

you left the uk on your own expense , according to these new rules because you left before 17 th of March 2008: IS151A means in your case: automatic ban for one year
you need to count from the day you left uk, then you can apply for a fiance visa , when the ban year is over i don t think they have the right to refuse you on the grounds of being an overstayer make sure your application is good watertight
your situation is not bad at all, your sponor (your g/f fiancee in uk ) needs to get all financials things sorted , house , bills ........etc
i am sure the outcome will be positive

g luck
