Lifting NRPF Condition on 3C Leave

Hello

I was wondering if it is possible to apply to have an NRPF condition lifted whilst on 3C leave?

I had limited leave to remain (outside the rules because of exceptional circumstances due to relationship with British Child).

I made an in-time application to extend this leave. The application includes submissions to have the NRPF condition lifted.

The application will likely take around 12 months for a decision.

Can I apply to have the NRPF condition lifted whilst waiting for a decision on my application to renew my leave?

Page 9 of the 3C statutory guidance suggests this isn’t possible but page 17 makes the situation less clear so I would be grateful for any help.

The way I would read it, the applicant can't make an application to vary the conditions of a Section 3C leave (as mentioned on Page 9), but the Home Office can vary the conditions if it feels the need to (based on the examples on Page 17).

In any event, the NRTPF does not have anything to do with Section 3C as it is not an application. It is simply a removal of restrictions as opposed to variation or grant of anything.

Sorry I don’t quite understand - are you saying that removing the NRPF condition is completely out of the applicant’s control whilst they are on 3C leave?
