overstay !!! now in trouble

need help. this is my case: i enter the uk in 2001 with a student visa for 6 months, then send my passport to home office for new visa and i didnt get it. i appeal but didnt win, after all of that i stay until december 2003, when i have a voluntary return.
in february2008 i get married here in my country with a british citizen and i gona apply for my settlement visa in like a month.
do you think that is gonna be refuse even it past such a long time with the new inmigration rules under paragraphe 320?
