Overseas Domestic Worker

Post by bigviv » Sun Jun 01, 2008 2:43 pm

hello all

i'm a british citizen who's married an indian citizen and she has a visa to live in the country now.

we would like to bring an overseas domestic worker who has been with my wife for the past several years.

i'm trying to fill out the vaf2 form on her behalf, but i'm stuck as to which sections to complete (the guidelines aren't much use i'm afraid).

do i need to complete 6.1/6.2/6.3?

any help appreciated - cheers!

Under the heading for 6.1 it says, "To be completed by applicants applying for a Work Permit, Highly Skilled Migrant, or other Work Visas"

It is the latter category that includes domestic workers, so fill in that section with relevant info. Domestic Workers don't require a Work Permit.

6.2 is for Working Holidaymakers, ignore that, and 6.3 relates to an applicant's dependants. Unless she is hoping to bring her family with her, (?), ignore that.

well, the visa got refused because we didn't have evidence for the following:

1) domestic worker was working in my wife's home (england, so obviously) or in a home used by her regularly - what on earth is regular? she's spent over 7/8 weeks in india since december 2007!!

2) no evidence to show a connection between my wife and the domestic worker - what could we have shown for this?! we had lots of certified affidavits that she has been working since 2004 for my wife, we have shown that since then to date cash has been taken out of my wife's bank account and given to the domestic worker - we have no way to really prove this really as there isn't a process for payslips or wage slips for this

we will appeal but wondering how to go about it, what other documentation to submit?

any help appreciated

thanks
