Help required in switching my ICT visa to general using FLR(HRO)

Hello,

I came to UK during 2017 using ICT tier 2 visa along with my wife and unfortunately by beginning of 2018 my wife got diagnosed with incurable disease. I would like to stay in UK for my wife's treatment moreover my project will be ending soon and I will be asked to move out of UK. I was trying to get suggestions on FLR(HRO) route but I got to know that the success rate is very less and need to spend more on it for my entire family.

My question is

1.Would it be possible to try this route initially for my wife and make her as the main applicant, once visa is granted for her will I be able to transfer my visa as dependent visa separately along with my kid?

2. Do I need to server cooling off period so that I can be dependent on under FLR(HRO)

Kindly suggest if there are any other route I can try. :(

Can you elaborate on what specific human right you think is engaged?

Hi Simon,

As Doctors told my wife cannot travel .I am in process to get a document so that I can show that and will get the medical details and conditions about my wife.

She is ongoing 4 weeks once treatment now which was earlier weekly.

Hope this will add more weightage for getting the visa.

When will your wife be fit to fly?
Have the consultants given a terminal prognosis or is it a likely long term cureable condition?

A Doctor saying she is not fit to fly is a pretty low level point without a significant explanation. So unless you elaborate more any advice that maybe or could be offered is of little use.

FLR (HRO) is the last of the last ditch applications you can make, the success rate for these is extremely low. Only the most exceptional cases get granted. Without being overly blunt unless your wife has a terminal condition and essentially you want to remain in the UK till she passes then do not expect a visa.

As previously asked - what HR’s do you believe have been engaged that makes your return to your home country impossible? If it things like cost of treatment then you are going nowhere with that claim.

Thanks for the reply.

Consultants told its a terminal prognosis, my wife would be able to travel after an year and that's not very sure.

Now I want to expedite this process because my project is going to be end in another 4 months and I will be asked to travel back by my company.

I read some where that M.P can also give some reference letters, I am planning to get that as well soon.

Can any experts here help me more on this..
I got letter from M.P to provide visa in compassionate grounds...

When I checked with one solicitor, he mentioned the letters and Nhs letters are of no use.. I am confused and don't know how to proceed on this... 😒

Also let me know the total processing time for HRO applications..
