Is my lawyer right regarding ILR eligibility??

Hi, I am a work permit holder. My WP and leave to remain expires 2 week before my 5 year stay in uk. My lawyer has adviced me that i can apply for ILR eventhough my Leave is expiring 2 weeks before 5 year period and i do not need to go through further Tier 2 process to cover 2 weeks as in his words " technically 1 can apply for ILR in 4year 11 months (59 months)". Is this true?? any advice will be highly appreciated.Thanks anuj

Absolutely, provided you qualify for it (ILR).

You must not send us your application more than 28 days before the end of your qualifying period.

5 years qualifying period - 28 days = 4 yrs 11 months.
