Confused

Post by ztech » Mon Aug 11, 2008 1:09 am

My Mom was an employee at an embassy. Her time was up and she was asked by the Ministry (back home) to return. She took voluntary retirement and is still here. This happened last year.

Now, I am dependent upon her and am also still here. Obviously, we are both illegal now.
I finished my degree and am currently working in a Bank as a consultant.
I am thinking of going for a HSMP, Work permit or switch to another category. I DID call up Home Office / BIA and asked if I could transfer over to IGS and they said NO, as only persons with student visa can transfer to IGS.

Help will be thanked.

P.S. I do not intend to become a British citizen or give a damn about this. I wish to work here for 5 years and then go back.

HSMP seems your best option. There are a fair few questions that need to be asked to give an indication as to your likely sucess.

Firstly - your Mum's visa - when does it run out? If it has already run out that will make things more difficult.
I am assuming you had the right to work off the back of the diplomatic dependent visa?
Are you self employed as a consultant or are you employeed through an agency or a consultancy firm.
What field of work are you in?
Have you looked at the criteria for HSMP or whatever the tier structure that now applies? Do you fit?
It makes no difference really but what country are you from?

1. Mom's Visa has already run out.
2.Yes, I had the right to work off the back of that dependant visa
3.I work in Finance
4.I am from a Commonwealth country.

I need to urgently change the staus of my visa to an acceptable one. And, I am not sure which one I can change to.

I am sorry there is little you can do right now that your leave to remain in the Uk is expired.
The only option is to apply for work permit/HSMP from your home country.Bearing in mind the "grace period" till october, otherwise you will be affected by the years of ban from entry the UK.

It might not be what you want to know, but you and your employers face a fine and/or jail due to your non-legal status. The government have implemented some tough measures to combat illegal working/hiring, and I am quite certain that your employers, if they are a large company, would not be keen to keep you on if they know about your status.

I suggest you go for Tier 1 or the IGS out of country. You should do this before 1st October, otherwise you face a ban from returning to the UK. I doubt the bank would want to apply for a work permit for you after finding out you don't have legal status.

One thing - what visa did your mother/yourself have initially, and what was the expiry date? And can you give us a timeline of your situation?
