doubts in getting student visa

Post by dkd1 » Wed Aug 20, 2008 3:45 pm

Hi,

This is regarding my student visa, I am going to apply it soon through British Embassy, India.

There is a problem regarding the student visa form.

I went to New Zealand for Post Graduate course, I did n’t complete the course, although I got the diploma but I overstayed 2.5 years in New Zealand. I approach local MP thinking I will get the work permit in the end he gave up and I informed the immigration department of New Zealand that I am leaving the country.

When I came back, I again applied for course in New Zealand, and New Zealand embassy in India, they rejected my student visa application.

Now I have decided to go to UK to study post graduate, and my brother who is working there, will sponsor me.

I have informed all the points in my UK student visa application, I just want to know, will this thing affect me in getting the UK student via?

Please advise me.

I will be grateful to you.

Kind regards
DKD

You're ticking all the wrong boxes.....

You didn't complete a post-grad course in NZ, so the ECO is bound to question your ability to do so in the UK. How are you going to overcome that?

Q. 5.2 of the student application form - "Have you ever been refused a visa for any country..." Answer, Yes. That doesn't automatically mean you should be refused for the UK, but it greatly increases the odds that you will be. You'll have to show what academic progress you've made or at least attempted since your previous setback, i.e. what's changed? Why do you really need this course in the UK?

Q5.5 - "Have you ever been deported, removed, or otherwise required to leave any country..." - if you were served with a notice as an overstayer, that pretty well sinks your application. If you made an application before your visa expired, and then waited 2.1/2 years until finally refused permission to stay, then left voluntarily, it's just possible to argue that you weren't "required to leave", but I would rate your chances as slim.

I applied, as you know from my previous thread, 2 weeks ago for the UK student visa and was refused due to poor answers and poor financial documentation.

Since I'm re-applying, will this question affect my application negatively? I do have much better documentation now (I hope).

I have never over-stayed or been refused a visa other then this.
