help please on name after marriage

Post by charliegal » Sat Aug 23, 2008 2:22 pm

hi all, hope you can help as i have a major problem on my hands.
I am married, and my husband is on a 2 year spouse visa. The problem is I kept my surname and have not yet changed my title from miss to mrs. I am going to do it in the next few weeks, but will it cause any problems when he applies for ILR next year? My hubby is very annoyed with me and says I have now ruined any chances as the authority wont believe we have been living together as a marrid couple.
Its all such a mess and my relationship is seriously affected.
Please help :( XXX

There's nothing to worry about. There is absolutely no requirement for married couples to share a surname. Presumably you have proof that you have been living together - bank statements, bills, doctor's letters, etc. - in one or both of your names. Your marriage certificate will show both names, right? And you both have passports/other ID in your names, right? So no problem.

It's a shame that your husband thinks it is such an issue, though.

Best of luck!

I agree

There is nothing unusual in this situation, loads of women do not change their names. It is even the norm in some cultures. Miss/Mrs/Ms is an honorific title and not your name. It is usual for banks/council etc to have trouble changing these things, do not worry about it, & perhaps you could keep your name if you want!

There is NO need or requirement for you to change your name or title to get ILR.

Good luck.
