URGENT HELP NEEDED

Good day,

I came to this country as a student. I got married in 2015.Got 5years resident permit. Got divorce in november 2018. Had a baby with a student from Africa (Tier 2) in 2017 and i am due for Permanent Resident in the year 2020.

HO wrote to my my new partner to leave the country.

I contacted my lawyer and i was told she can fill the section 120 base on my relationship with her.

My worries is, will i still be granted my PR or ILR if i am involved in her application? WIll my child be affected and what can she do so that she wont be deported?

Kindly advice on what to do.

There is no reason for the Home Office to go after you or after your baby. Your partner may or may not be able to stay in the UK but this shouldn't affect your own immigration status.

For how long have you been together? Do you live together? Do you have joint accounts? Are your names both in the utility bills and council tax? Do you work? Do you earn more than £18600/year?

In the UK, having a partner (or even a spouse) and/or a kid doesn't give an absolute right to stay. Further conditions have to be fulfilled.

What are your nationalities? What were the nationalities of the spouse you married in 2015? The rules and requirements vary depending on the nationality of your 2015 spouse and that may be very relevant to any advice that we give you.

Yes we live together and our names on council tax. We have been together since the child was born.

I work and earn above £40,000/year for the past 3 years.

Further advice is needed.

The lady i got maaried to in 2015 is Liberian/Irish, I am from Ghana while my baby mama is from Cameroun.
