ILR and Dependent Visa

Post by kiggle » Fri Oct 03, 2008 6:57 am

I'm about to apply for my ILR after being in the UK for 5 years on a company-sponsored work permit. With my work permit my wife has a dependent visa that allows her to live and work in the UK for as long as I am here. From what I understand, when/if I get ILR my wife's dependent visa will no longer be valid. Unfortunately, she has not been in the UK the same length of time a I have and therefore she cannot apply for ILR. To make matters more complicated she has spent the last 1.5 years working in Uganda with an NGO. What options are there for her to rejoin me in the UK, with the benefit to live and work here?

Once you have your ILR you will be said to be "settled" in the UK and thus when your wife wishes to move back to the UK, to resume family life with you, she should apply for a standard 27-month spouse visa to enable her to return here.

After she has been in the UK for nearly 2 years, on that visa, she would be able to apply for her own ILR.
