worried about the new points system

Hello All and a Good day.

My name is Giuseppe I'm actually a British born Italian.
And I believe that the points system is a good idea however I am also quite
worried about it too.
My Girlfriend who i love so much has been in this country since 2006 and her working Visa will expire in 2011. However I'm worried that this points based system will affect her in applying for citizenship/residency when her 5 years have passed, I'm not too sure who i need to speak to and thought that this would be a very good place to seek the advice i need and to put my mind at rest.

If anyone could perhaps answer my question I would be mostly grateful.

If she doesn't qualify under the PBS, you can get married and she will then be under EU immigration rules.

Thank you. But thats where i'm confused would she be under the PBS even though she came into this country in 2006 her visa expires 2011.
What I'm trying to say is even thoughe came here in 2006 would she be exempt from the PBS

If she's applying under the UK immigration route, she'll be under PBS. It doesn't matter when she entered the country.

What category of work visa is she currently on?

HSMP holders:

How many years you must be in the United Kingdom before applying for settlement wrote:You must complete a continuous period of five years in the United Kingdom in an eligible immigration category before you can apply for settlement, and you must meet all the requirements of the immigration rules before you are eligible to apply.

Work permit holders:

How many years you must be in the United Kingdom before applying for settlement wrote:You must meet all the requirements of the immigration rules at the time you apply for settlement.

At the moment, you must have been in the United Kingdom for a continuous time of five years in an eligible immigration category before you can apply for settlement.

The immigration rules may change and you must meet the rules that are in place at the time that you apply for settlement.

There's also unmarried partners (Section 9).

she is on a 5 year work permit which started in 2006 and ends 2011, she currently works as a Carer, however in her home country she is a qualified Nurse however over here it is not recognized.

Which country is she from/did she study? Maybe she can work on getting her qualifications recognised?Has she checked this out?

Hello Sakura (I'm guessing that means Cherry Blossom in Japanese) Anyhoo my GF is from the Philippines and she is a qualified Nurse over there, However she isn't over here.
What she would need to do first is an English test based on speaking writing etc, etc called the IELTS, Then she would need to obtain a decision letter from the NMC (National Medical Council) and then after that she would need to find a particular place that will let her do her 6 months adaptation in order for her to get her Medical pin in this country then once all that has checked through she can apply for residency.
Seems like alot of work I wish there was a much easier way
