Looking for old info on freedom of movement

Post by aman90 » Thu Feb 06, 2025 10:13 am

Hi admins moderators gurus.. haven’t visited this forum in quite a while now. Due to the high influx of pop ads it’s really difficult to navigate or search through old posts. I was wondering if you guys could help. I’m looking for information regarding freedom of movement as Uk spouse visa(holding passport that normally would need a visa) holder PRE Brexit.
I’m aware that Uk spouse visa holders could accompany their respected British passport holding spouses to Europe or Schengen area by virtue of a certain freedom of movement act. I’m also aware that many border officials were not aware of this rule and hence it was advised here to take a print of the rule/act and show to the border official. It actually worked then and this rule was validated in a country in Europe. Can someone help me please..

I guess you're aware that that boat sailed a long time ago. You as the spouse of a Brit can't do that anymore.

It's called Directive 2004/38/EC and still applies to all EEA citizens and their spouses in the EEA.

But of course, after Brexit, UK citizens ceased to be EEA citizens and the UK ceased to be a part of the EEA. So freedom of movement and the Directive is no longer applicable to UK citizens in the EEA or to EEA citizens in the UK.

If you tell us why you need that information, we can guide you more precisely to what you are looking for.
