ILR for dependents

All,

Need your expertise in my issue.

Im soon to complete 5 years in UK and would be applying for ILR (PR) .

I have a continous stay of 5 years in uk with no holidays extending for more than 2 -3 weeks outside uk. Im an HSMP visa holder.

But my wife has had to live outside UK for the delivery of the baby for more than 6 months in a stretch and then again for some family occasions for a few more months. She basically does not pass the 90 day rule.

My question is ,

Is PR dependent only on the main applicant ? Which means if I quailfy does my dependents also qualify or they have seperate passing criteria independent of me?

My baby who was born in India is about 18 months now. would he also qualify for PR ?

Here is the reply from Home Office"

Please be advised that, provided your wife and child have Entry Clearance as your Dependants are resident in the UK at the time you submit your application, they can be included on your application regardless of the amount of time that they have spent outside of the UK.

Yes, You all three can apply for PR at the same time. Its usually this rule (leaving out side UK for certain period) is applied for main applicant.
