Settlement visa refused

Post by dimitr1 » Sat Oct 24, 2009 12:27 am

My Wifes settlement visa was declined on the grounds of insufficient evidence of contact.
My Wife and i were living apart for 18 months prior to the application. I had to study for a 5 yr course which was passed in 4 months, i supplied proof of this along with proof of starting a new business as a result.
I didnt initially provide evidence of contact as all was made from a callin card system via the mobile phone.
I have since provided 55 pages of evidence to the visa section and the AIT.
My MP has also gotten involved,
Does anyone have an idea as to how long it will take to hear from the visa section?

Have you appealed agaisnt te decison on the appropite papers (Appeal Notice)?.

If you have done this then the Entry Clearance Manager will review decison in view of the recent docs you have supplied. could take upto 2 months before you get response.

If he wont accept your reasons , then I am afraid it will go to an appeal hearing and that could take 6 months or so.

Thanks for your reply.
I was provided with an AIT-2 form by the embassy.
The refusal notice was issued on the 14/08/09 and my wife and i recieved this on the 23/08/09.
As evidence i initially provided moneygram slips to prove both funding and contact.
The visa centre refused to accept my passport, and my wife didn't make photocopies.
When my wife recieved a call by a translator from the embassy, she answered the ECO's queries of what she was doing while in the Ukraine, but also advised the translator that i was next to her. This was approximately 6 weeks after submittion of application.
When we recieved the refusal notice, it explained that the embassy only accept letters, phonebills and emails as valid evidence. (This seems to be vastly outdated).
I provided both the AIT and the embassy with 55 pages of evidence which consist of copies of my passport, the initial submitted money gram slips (Which were returned), phone bills which show a handful of direct calls, and a hell of a lot of calls made via topup call, along with a transcript via skype showing that it is not possible to have statement by topup call showing who i have been calling.
This information was wmailed to the embassy on the 24/09/09.
I recently sent an email to the embassy addressed to the ECM, asking if there is any chance that the can process the additional sent information in order to speed up this process. They replied the following:
"Dear Mr Christofi,

Thank you for your email.

We confirm receipt of attached files, including your passport copies, skype printouts, etc. All documentation including appeal grounds will be forwarded to the case visa officer for review.

Sincerely yours,
Visa Assistant |Visa Services | UK Border Agency | British Embassy | Visa/Consular Section | 4, Glybochytska Street 04050 Kyiv

email: britvisa.kyiv@fco.gov.uk
F: +380 44 494 3418
Website www.ukvisas.gov.uk www.ukvac-ua.com"

I sent back an email asking to confirm wether the ECM will be reviewing the additional documents as per the website, or if it is down to the ECO.

What do you make of this?
Is there another way of speeding up this application?

If at all possible, can you call me as i have so many questions regarding this issue? (07930885652 Dimitri)

Regards

Dimitri

Hi Battley Khan

Thankyou for the additional information.

Do you have any idea, as to how long i should expect to wait for a decision to be made?

I appreciate that the information provided on the visa website, is to be used as a guide, but if you have more precise information, i would be grateful.

Also do you know of any other ways i can speed up the review process?

Best Regards

Dimitri

I dont want the case to go to tribunal.
My wife and i have been apart for long enough without having to wait for a court hearing.
Is there a quicker way of doing this?
Do you know how long it actually takes for an ecm/eco to review the additional evidence from date of reciept?
Do you know how long it tales to issue the visa from the date the decision is overturned?

In reconsideration

ECO mgr mostly say that their stand is correct

no chince than fight till last or reapply and shell out cash and no gurantee

so u can reapply as well as fight so u can save 2 months
