difficult situation

Post by Jwana » Sat Oct 24, 2009 6:59 pm

hi there

at the risk of getting hostile responses, i'm posting here to try to find some advice for my partner from kenya.

he came here on a work visa but his employer did not extend this despite keeping on the workers and making many promises to do so. he's now overstayed his visa and is desperate to return home asap. the only reason he's stayed has been to try to get some money together which has been difficult.

he does not want to return to live in the UK but would like to be able to come back on a visitor/buisness visa for short periods later.

he realises that when he leaves the UK he runs the risk of being stopped and detained. so i have 2 questions:
- does anyone have any advice as to which aiport it would be easier to leave from with less risk?
- if he is stopped what will happen next? will he be detained and then deported or will he be allowed to board his flight but a ban (12 months or longer?) put on his record.

thank you!

jwana

If he has overstayed for longer than 28 days, then he may be subject to a ban.
