From EEA FP to ILR

Post by makwco21 » Wed Oct 28, 2009 7:44 pm

Hi everyone! I have a really upsetting problem and I was wondering if any of you could give me a hand.
Me and my partner (british citizen) lived in Milan for 4 years then decided to move to England so I went down to Rome to apply for a visa. There I decided to apply for a partnership visa and everything was ok till I got to the casher to pay for it she told me to think about it again as I could have applied for EEA FP which was free of charge, I asked her if I could get ILR with it and she said yes so I did, I mean, they offer me to save 700 euros why would I say no to that? well, BIG MISTAKE!!! As I found out now that Im in the UK, there is no way I can get ILR with that kind of visa, legaly I should be able to get ILR right away as I lived with my partner 4 years abroad but by getting EEA FP I just lost any right I had and now it will take me 5 years to get ILR. Is it right? do I lose my chance of getting ILR in short time? as well, I was told to apply for EEA2 and I can see how people are finding the waiting period for EEA2 too long... more than 10 months usually, thats crazy!!!! Can I take another way?
Someone told me that I wouldnt have to wait 5 years with EEA2 visa as my partner is UK citizen and not just european like usual cases, is there something else I can do? Please I need some advice as my visa will run out soon and I really dont want to go to that long period to get my UK passport.
Thank you all for your time and please give me a hand!
Cheers!
Luis

You haven't lost anything to be honest. You can go back to Italy and apply for the spousal visa, the EEA family permit or Resident card does not preclude you ability to acquire Spousal visa.

Therefore don't loose sleep over it.

Really? thats good news... well, in a way, Is there anyway I can do anything from here? as now Im in the UK, I finally got a job and they obviously wont wait for me to go back to Italy, wait 3 months which is the time it takes and then take me back. That means I need to rent a place in Italy for 3 months as I wont be able to come back to the UK without passport. I mean, its great I can still do it that way but its means lots of time and lots of money (living in italy for 3 months is not cheap)
Thank you for your help anyway.
