Non-Eea National Married To Eea National - Name Change

Post by seputus » Sun Apr 11, 2010 1:30 am

Hello,

I am a Canadian citizen living/working in the UK by way of marriage to an EEA citizen.

I’ve begun the process of changing my last name to the English equivalent of my partner’s last name, and I intend on getting a new Canadian passport with my new last name.

I have a concern about re-entering the UK after taking a trip abroad. Please advise me if it is sufficient for me to carry:

• My old passport with the UK-issued EEA residency stamp
• My new passport with my new name
• The UK deed poll showing that I’ve changed my name

I understand from the Home Office website that under EEA rules, I am free to re-apply to have my stamp transferred, but the processing time is very prohibitive as I am a frequent traveller.

I would have thought that this kind of situation is more common, but a thorough Google search has only revealed 1 forum post that says it's okay. I tend to think it would be fine - as under EU rules, EEA family members don't even "need" to apply for residency as long as they can prove they are the family member of an EEA national who resides in the UK and is exercising treaty rights ...

... but it sure would put my mind at rest if anyone else could confirm that!

Any assistance is appreciated!

seputus, apart from suggesting that you carry your marriage certificate, as well as the items you list, I don't think you will have a problem re-entering the UK.
