Gurus,

If Mr Smith a British Citizen marries a wife (Mrs smith) and then due to Mrs. Smiths infidelity; Mrs. Smith bears a child from someone else other than Mr Smith :roll:

Obviously the relationship collapses although by now Mrs Smith has become British. (but child was born before Mrs. Smith became British)

The father of the child is not a British Citizen.

what is the status of the Child?

British Citizen by registration depending on age of child. What is the place of birth?

The biological father's non British citizenship is not relevant as far as the child's British citizenship is concerned. The child is entitled to be registered as a BC because the mother is now British.

Chess, I think it depends on whether Mrs Smith had ILR when she gave birth to the child. If she did, and the child was born in the UK, then the child is British automatically.

However if she did not have ILR when the child was born, or the child was born outside the UK, then as already suggested, it would be a question of registering the child as British.

I am assuming that Chess is still asking about the case that he posted a few days ago i.e. child is born in the UK and mother subsequently obtained ILR/BC. i.e a Section A appication.
