I agree with this but if the applicant wins their case because of the incompetence of the ECO in refusing the application should get their money back.

All others should be made to pay for it, as it clogs up the sytem. I think this is a route that the HO will follow to make it as hard as possible for new immigrants to come to this country because they legally cant stop it anyother way.

I totally agree with that. Otherwise there is no incentive for UKBA to "get it right" first time.
