I am in the middle of negotiating a consent order with the HO. I have to agree the terms with them and then a Court of Appeal judge will approve the order.
Anyway I have a few questions that perhaps those with experience in this area can assist me with.
1. I asked for an undertaking from the HO/Tsols that my visa will be granted within a week of signing the order and I have been told they dont give undertakings. Is this true? I am worried that after signing the order, I could wait indefinitely for the HO to endorse my visa. Is it a case that they cant give undertakings or that they do not like giving them?
2. Can I ask for a clause in the consent order schedule saying that after we sign the order I can go to a PEO straight afterwards and have the visa endorsed? This would cut out the potential long wait.
3. Any ideas on how I can agree a consent order which wont leave me waiting if it can be avoided? I know ultimately that the HO have to comply with orders but I do not want to wait indefinitely or have to go back to the courts to ask them to enforce the order.
