to resolve this matter,first of all the first italian guy who posted the probleme he is having need to ask himself one question how far he is willing to go on with this, and how much he want this relationship to the indian shap to work out.

you already discussed options here, for the indian guyto go back to india without a passport or a visa its very simpleall he have to is contact the UKBA and tel them the story,they will advice you to get in touch whith his ambassy and get a clearance or emergency travel document takes 48hours.
once in india he can regularise his paper work officialise his relationship and apply.
or altenatevly he can stay in the countryapply for COA the passportis irrlevant based on my experience,i overstayed in uk for more than 6years
apply for COA and approved ,
now let be clear COA is just for marriage no one canstopped to get married,but there is 2 forms
1 COA approved but you need to leave thecountry
2 COA approved with option to apply for further leave to remain
inboth case the COAis approved because simply the UKBA cant stoped anyone married anyone.
so to the attention of the italian guy give itfew month get bills take fotos
letter etc more importanly finnance,
now as an overstayer he is not allowed to work,so you must demonstrate that you can supporting him through his staying,
i apply for COA without a passport got married
witha marriage certificate and COA you apply at your ambassy for anew passport based on your new circumstences than you will have to make a choice on how to go in order to get avisa.

now about this i haveana opinion ,dunno exactely what india's positionon same sex marriage if they are not favorable of that,
a humain right case would be very likly to succed.
