Extension refused. Going back after 7.5 years

Hello

My Tier 4 extension has been refused due to maintenance funds and appeal has been dismissed as well.

2nd appeal is in process but i am planning to go back and get entry clearance.

Just to confirm that if i come back within 6 months, would i be still eligible for 10 years ILR rule??

Please give your inputs.
