Help - Ordinarily Residence????

Help - Ordinarily Residence????

Hey guys,

Sorry my situation is kind of long and complicated but here it is:

I moved to New Zealand with my mother and step family at the age of 15 (23/09/07) I am now 19 (D.O.B 04/09/92) and I am moving back to the UK (My home country) to live with my father who has always remained in the UK on the 24/01/12. I have never properly settled in New Zealand and never wanted to move here in the first place but was never given the option to stay in the UK and was forced as a minor to move to NZ.

I have applied at University's and College's in the UK and have been told that I do not meet requirements for funding and I have to pay International Student fees by one of the places that I have applied. I do not understand this as I was born in the UK and was raised there until I was 15 years of age and then was forced to leave my country.

Also I have visited the UK on 2 occasions since I have lived in NZ once was to visit family around DEC 2008- Jan 2009 I stayed for approximately a month and I also went back on JAN 2011 - APRIL 2011 for approximately 3 months. I worked on this visit at a local supermarket. Unfortunately my mother in NZ got sick and I had to return to NZ. But now she has pulled through and I am on my way home FOR GOOD!

I think its because I am a Non Ordinarily Resident, I understand I can be a Ordinarily Resident when I get back to the UK when I prove I am there for good (One way ticket etc) But is there anyway to get around me have to be a Ordinarily Resident for 3 years for me to be eligible for funding and pay normal home student fees. Is there any discretion around this topic if I rang someone up and talked to them about my situation? and if so who do I ring to become a Ordinarily Resident?

You have not been resident in the UK for the past three years and therefore have to pay international fees. It does not matter that you are British. Ordinarily resident means where you normally live and have lived prior to whatever situation is demanding this requirement; clearly not the UK in your case. This will apply to any FE or HE course you choose to apply for and there is no way around this if the education provider does a proper job of checking applicant's circumstances, which all seem to do.

Thank you for the quick reply. I just thought that because I was a minor and was forced to move there would be some discretion around this decision. I have visited the UK numerous times in my time living abroad so I was wondering if I kept my Ordinarily residence by visiting back.

No, visiting is not residence. My British children are same boat as you. We live outside the UK and have not been resident there for some time even though I maintain property and pay UK tax. They would, however, be subject to international fees if and when they opt to study at a UK university.

Damn well that's going to cost a fortune.... Looks like I am just going to have to waste 3 years of my life doing nothing until I can afford to study...

I spent more than 90 days in the UK in 2011 and I will be spending more than 90 days in the UK this year and the whole of next year so by the September 2013 start date for University's will I be eligible for Home fees due to me being a Ordinarily resident by then?

NO
90 days has no bearing , you have to be resident .
Move back work and save a bit then go to college.
Not that big a deal in life , may seem like it now but when you look back it will be quite short .

So is it up to the Educational Institute to determine whether you are a Ordinarily Resident? and to give you international fees or home fees?
