my sister who is nurse came over here a a helth care assistant and has been working in elderly home. to start her adaptation 'supervised practise" employer changed in to "adaptation nurse work permit" after adaptaion she received her PIN number [got registered] from Nursing and midwifery council' another employerd applied her work permit as registered general nurse . but the application received there on 14th august. now they sent a letter to employer saying the post need to be advertised. my question , does it required from changing work permit to workpermit. is that advertisment at the job centre plus? or do they accept online adverts? any other legal way we can go ? pliz reply

I regret to say that the answer to that question is "yes". (Which as I posted when the change to the "occupational shortage list" was first announced seems to be very unfair.)

Where the employer needs to advertise? I would expect NHS organisations will have received guidance about that from some central NHS body. If you download this document and then look at para 48, you will see that it is not totally clear about whether merely using the Job Centre is sufficient.

many thanx john for yr kind reply. it is very unfair that the such decision from the home office. what if a person holding a workpermit would like to change employer? if the second employer dont bother to put the adverts this particular person will be tied-up to one employer. isnt it? one more question john, on what grounds the employer can say that the he or she didnt find a suitable worker here in order to employ my sister? thanx in advance

I think it would be useful if you have a look at the WP application form ... click here ... but I emphasise that such form is submitted and paid for by the employer.

Having downloaded the form have a look at Section 12 of the form .... go to page 9 of 14. There you will see what sort of information needs to be supplied by the employer who is applying regarding the advertising of the post.

many thanx john. can i clarify one mor thing, one of my friend who is on a registered general nurse work permit [ for a nursing home]and new employer is willing to apply her a work permit as registered general nurse [to another nursing home] i guess, this will be a straight forward OR does it required advertisment? i hope not. please, i would like yr input.
